In a hypocritical move that shows how silly their positions on trademark are, the Chia Project Twitter handle has tweeted an advertisement for their project using a trademarked phrase that they don’t hold.
Its basically obvious to everyone that they chose their project name to invoke the good feelings that people have for Chia pets, which is a trademark that has existed longer than some of the team members have been alive I’m sure. That trademark is owned by Joseph Enterprises, the makers of Chia Pets, and they also own a trademark on Ch-Ch- Ch-Chia! Is the Chia Project or Chia Network claiming some sort of association with them? I’m confused.
Of course not, and when Chia Project uses that trademark in order to tweet this out and pump their project they know that it is fair use. Just like when people invoke their name while doing business it is also fair use, as long as it is true and accurate. They know this is true, because they didn’t hesitate to tweet this out. They also know that people referring to the Chia network are not necessarily referring to the company and no confusion or damages are suffered when that happens.
